Policy towards asylum seekers has been a controversial topic for more than a decade. Rising numbers of asylum applications have been met with ever-tougher policies to deter them. Following a period of policy harmonisation, the EU has reached a crucial stage in the development of a new Common European Asylum System. This paper seeks to shed light on what form this should take. It summarizes the development of policy to date and it argues that these policies have been too tough, even from the point of view of EU citizens. Using an economic framework, it examines scenarios with different degrees of policy harmonisation and integration among EU countries. Finally, it argues that there is an important role for enhanced burden-sharing arrangements.

This paper reviews the origin of the constitutional rule on asylum & the development of German asylum policy from 1948 onwards. The constitutional rule on asylum was central to the political conflict that escalated after the mid-1980s, resulting in a violent mobilization & an amendment to the constitution in 1993. The consequences of this amendment & the impact of Germany's asylum policy on European policy & regulations after 1993 are discussed. The restrictive asylum & repatriation policy after the amendment of 1993, especially with regard to war refugees from former Yugoslavia, is described. Finally, the paper discusses the impact of the change in government in 1998 on Germany's asylum policy, & draws some general conclusions about the discourse on refugees in relation to the self-image of the host society. 65 References.
